Motion to withdraw plea

Utah Code section 77-13-6(2)(b) requires a request to withdraw a guilty plea to "be made by motion before sentence is announced." Utah Code Ann. � 77-13-6(2)(b) (Supp. 2004). Flague concedes that he did not make a timely motion to withdraw his guilty pleas.(1) The docketing statements filed in this court raise the single issue that the guilty pleas were not taken in compliance with rule 11 of the Utah Rules of Criminal Procedure.

PER CURIAM. Tyler Jefferson appeals from the judgment and sentence
entered after he pleaded guilty to misdemeanor harassment and fourth degree
assault. He also appeals from an order denying his motion to withdraw his
guilty plea. Jefferson's court-appointed attorney has filed a motion to
withdraw on the ground that there is no basis for a good faith argument on
review. Pursuant to State v. Theobald1 , and Anders v. California2, the
